Key terms used in these Terms:

• ◆"Kundlo", "the Service", "we", "us", "our" - The Vedic astrology AI assistant operated by the Company via WhatsApp and www.kundlo.com
• ◆"You", "User", "your" - The individual accessing or using the Service
• ◆"Account" - Your Kundlo account, identified by your WhatsApp phone number
• ◆"Profile" - A birth-data record (name, date/time/place of birth) you create within your Account for yourself or another person
• ◆"Kundlo Points" - Virtual credits used to access paid features of the Service
• ◆"Reading" - Any astrological analysis, prediction, chart interpretation, or report generated by the Service
• ◆"PDF Report" - A downloadable PDF document containing astrological analysis generated by the Service
• ◆"Plan" - A prepaid subscription tier (Prarambh, Vistar, Sampoorn) that grants Kundlo Points
• ◆"Consent" - Your affirmative agreement to the Privacy Policy and these Terms by tapping "I Agree"

Acceptance of Terms

By tapping "I Agree" and using the Service, you confirm that:

• ◆You have read and understood these Terms and the Privacy Policy.
• ◆You are at least 18 years of age (or the age of majority in your jurisdiction).
• ◆You are legally capable of entering into a binding agreement.
• ◆If you are accessing the Service on behalf of an organization, you have the authority to bind that organization.
• ◆You agree to use the Service only for lawful purposes and in accordance with these Terms.

Description of Service

What Kundlo Provides

Kundlo is a Vedic astrology AI assistant that provides:

• ◆Birth chart (Janma Kundli) computation based on Vedic astrology (Jyotisha) principles
• ◆Personalized astrological readings covering personality, career, relationships, marriage, health, and life events
• ◆Dasha (planetary period) analysis - Vimshottari and other dasha systems
• ◆Gochar (transit) analysis - current planetary transits and their effects
• ◆Milan (compatibility analysis) - horoscope matching between two individuals
• ◆PDF astrology reports - downloadable reports delivered via WhatsApp
• ◆Panchang and festival information - tithi, nakshatra, yoga, and auspicious timing
• ◆Multi-profile management - create and manage birth profiles for family members
• ◆Conversational AI - ask questions and receive astrology-based guidance in natural language

How Kundlo Works

The Service operates through WhatsApp messaging. You interact with the Kundlo WhatsApp number by sending text messages. An artificial intelligence system (powered by large language models) processes your messages, birth data, and astrological computations to generate responses.

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

For Entertainment and Informational Purposes Only

All astrological readings, predictions, analyses, reports, and guidance provided by Kundlo (collectively, "Readings") are provided strictly for entertainment and informational purposes. Readings are generated by artificial intelligence based on astrological calculations and do not constitute:

• ◆Medical, psychological, or psychiatric advice
• ◆Financial, investment, or trading advice
• ◆Legal advice
• ◆Professional counseling of any kind
• ◆A guarantee of any future event or outcome

No Reliance

You acknowledge that:

• ◆Astrology is a belief system and is not recognized as a science. Its accuracy and validity are not scientifically established.
• ◆Readings are AI-generated based on astrological data and may contain errors, inaccuracies, or hallucinations.
• ◆You should not make important life decisions (including but not limited to medical decisions, financial investments, marriage, divorce, career changes, or legal actions) based solely or primarily on a Reading.
• ◆You are solely responsible for any decisions you make after receiving a Reading.
• ◆Kundlo, its operators, employees, and affiliates are not liable for any consequences arising from your reliance on a Reading.

Eligibility and Account

Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older.

Account Creation

An Account is created automatically when you first message the Kundlo WhatsApp number. Your Account is identified by your WhatsApp phone number. One phone number corresponds to one Account.

Account Security

You are responsible for maintaining the security of your WhatsApp account and phone. Do not share your WhatsApp account with others. You are responsible for all activity that occurs through your Account.

One Account Per Person

You may maintain only one Account. Creating multiple Accounts is prohibited.

Profiles and Birth Data

Creating Profiles

You may create multiple Profiles within your Account, each containing birth data (name, date, time, and place of birth) for yourself or another person (such as a family member).

Accuracy of Birth Data

You are responsible for providing accurate birth data. The accuracy of astrological Readings depends entirely on the accuracy of the birth data you provide. Kundlo is not responsible for incorrect Readings resulting from inaccurate birth data.

Third-Party Birth Data

When you create a Profile for another person (who is not the Account holder):

• ◆You represent and warrant that you have obtained that person's consent to share their birth data with Kundlo.
• ◆You are solely responsible for any consequences of sharing another person's data.
• ◆Kundlo is not liable for any claim arising from your unauthorized sharing of a third party's personal data.

Milan (Compatibility) - Dual Consent

When requesting a Milan (compatibility analysis), you must provide birth data for two individuals. You represent and warrant that you have the right to share bothindividuals' birth data and that both individuals have consented to such sharing.

Acceptable Use

You agree not to:

• ◆Use the Service for any unlawful, harmful, fraudulent, or infringing purpose.
• ◆Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or internal workings of the Service or the AI models used.
• ◆Abuse, harass, threaten, or send offensive content to the Service or its AI assistant.
• ◆Attempt to bypass, circumvent, or manipulate the payment system, Kundlo Points balance, or Service limitations.
• ◆Scrape, data-mine, or systematically extract data from the Service.
• ◆Use the Service to generate content that is defamatory, hateful, or discriminatory.
• ◆Impersonate another person or provide false identity information.
• ◆Use automated means (bots, scripts, API calls) to access the Service outside of the provided WhatsApp interface.
• ◆Resell, sublicense, or redistribute Readings or PDF Reports for commercial purposes without written permission.
• ◆Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with other users' access.
• ◆Attempt to extract personal data of other users from the Service.

Prohibition on Using Content for Training AI Models

You are expressly prohibited from utilizing any content, data, information, or materials available on this website or through our Services for the purpose of training or developing AI models or any other machine learning algorithms.

• ◆This prohibition extends to, but is not limited to, any form of data extraction, scraping, copying, or downloading of website content, whether automated or manual, with the intent to use it as training data for AI models.
• ◆Violation of this clause may result in legal action, including but not limited to, seeking injunctive relief and monetary damages.
• ◆The website reserves the right to monitor and enforce compliance with this prohibition, and any unauthorized use of the website's content for AI model training purposes will be considered a material breach of these Terms.
• ◆By using the website, you signify your agreement to abide by this prohibition and understand that any unauthorized use of the website's content for AI model training may lead to legal consequences.

Kundlo Points, Plans, and Payments

Subscription Plans

Kundlo offers prepaid Plans that grant Kundlo Points, which are consumed when you use paid features. The current Plans are:

• ◆Prarambh (Trial): Free - Limited points - One-time free trial for new users
• ◆Prarambh: ₹50 - 150 pts / 15 days / 5 profiles (3.0 pts/₹) - Entry-level plan
• ◆Vistar: ₹100 - 400 pts / 30 days / 15 profiles (4.0 pts/₹) - Mid-tier plan
• ◆Sampoorn: ₹500 - 3000 pts / 30 days / 50 profiles (6.0 pts/₹) - Premium plan

Plan pricing and point allotments are subject to change. Changes apply to future purchases only and do not affect already-purchased Points.

Kundlo Points

• ◆Kundlo Points are virtual credits with no cash value and are not a financial instrument.
• ◆Points are non-transferable - they cannot be transferred to another Account or converted to cash.
• ◆Points are consumed when you use paid features (e.g., generating PDF reports, advanced analyses).
• ◆Points have expiration dates tied to the Plan's validity period (15-30 days). Expired Points are forfeited.
• ◆Each Plan has a profile limit (5-50 profiles) for storing birth data.
• ◆If you purchased a Plan and Points were not credited due to a technical error, contact us with your payment confirmation for resolution.

Payment Processing

• ◆Payments are processed by Razorpay, a third-party payment gateway.
• ◆ Kundlo does not store your card, bank, or UPI details - Razorpay handles all payment information securely.
• ◆By making a payment, you agree to Razorpay's Terms of Service and Privacy Policy.
• ◆Payment confirmation is received via a verified Razorpay webhook, and Points are credited automatically.

Free Trial

• ◆New users receive a one-time free Prarambh trial with limited Points.
• ◆The free trial is granted once per Account (identified by WhatsApp phone number).
• ◆Creating multiple Accounts to abuse the free trial is prohibited and may result in permanent suspension.
• ◆Free trial Points may have a shorter validity period than purchased Points.

Refund Policy

• ◆All sales are final. Kundlo Points, once purchased, are non-refundable except in the following circumstances:
• ◆Payment debited but Points not credited: If your payment was successful but Points were not added to your Account due to a technical error, we will credit the Points or issue a full refund upon verification.
• ◆Duplicate payment: If you were charged twice for the same Plan, we will refund the duplicate charge.
• ◆To request a refund under the above circumstances, contact us within 7 days of the transaction with your payment confirmation.
• ◆Refunds, if approved, will be processed back to the original payment method within 7–10 business days.
• ◆No refunds will be issued for:
  • ◆Dissatisfaction with astrological Readings (see Astrology Disclaimer above)
  • ◆Unused or expired Kundlo Points
  • ◆Accounts suspended or terminated due to violations of these Terms
  • ◆Purchases made more than 7 days ago

Privacy

Your use of the Service is governed by our Privacy Policy (www.kundlo.com/privacy-policy), which describes how we collect, use, store, and share your personal data. By using the Service, you consent to the data practices described in the Privacy Policy.

Intellectual Property

Kundlo's Intellectual Property

• ◆The Service, including its software, AI models, astrological computation engine, algorithms, prompts, user interface, PDF report designs, and all associated content, are the exclusive property of Kundlo and are protected by Indian and international intellectual property laws.
• ◆You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
• ◆You may not copy, modify, distribute, sell, or create derivative works based on the Service without prior written consent.

AI-Generated Content

• ◆Astrological Readings and PDF Reports are generated by AI specifically for you based on your birth data and questions.
• ◆ You may use Readings for personal use - including saving, printing, and sharing with family.
• ◆You may not use Readings for commercial purposes (e.g., selling readings, offering astrology services using Kundlo output) without written permission.

Your Content

• ◆You retain ownership of the birth data and personal information you provide to the Service.
• ◆By sending messages and data to Kundlo, you grant Kundlo a license to process your data for the purpose of providing the Service, as described in the Privacy Policy.
• ◆Kundlo does not claim ownership of your birth data or personal information.

Disclaimers

"As Is" Basis

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Kundlo disclaims all warranties, whether express or implied, including but not limited to:

• ◆Implied warranties of merchantability and fitness for a particular purpose
• ◆Accuracy, reliability, or correctness of astrological Readings
• ◆Uninterrupted or error-free operation of the Service
• ◆Compatibility with your device or WhatsApp version

No Guarantee of Results

Kundlo does not guarantee that:

• ◆Any astrological prediction will come true or be accurate
• ◆The Service will meet your specific requirements or expectations
• ◆The Service will be available at all times without interruption
• ◆Errors or bugs will be corrected

Limitation of Liability

General Limitation

To the maximum extent permitted by applicable law, in no event shall Kundlo, its operators, employees, affiliates, agents, or service providers be liable for:

• ◆Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• ◆Any loss of profits, data, business, or goodwill arising from the Service.
• ◆Any damage to your device or software.
• ◆Any emotional distress, harm, or negative life consequences arising from reliance on astrological Readings.
• ◆Any action or inaction you take based on a Reading.

Financial Limitation

Kundlo's total aggregate liability arising from or related to these Terms or the Service shall not exceed the total amount you have paid to Kundlo for the Service in the 12 months preceding the event giving rise to the liability. If you have not made any purchase, Kundlo's liability shall be limited to ₹500 (INR).

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and is your exclusive remedy against Kundlo for any claims arising from your use of the Service.

Third-Party Services

Kundlo uses third-party services (WhatsApp/Meta, Razorpay, AI/LLM providers, Supabase, Redis, Open-Meteo). Kundlo is not responsible for:

• ◆The acts, omissions, or data practices of these third parties
• ◆Service disruptions caused by third-party outages or changes
• ◆Data loss or breaches occurring on third-party infrastructure

Indemnification

You agree to indemnify and hold harmless Kundlo, its operators, employees, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• ◆Your breach of these Terms.
• ◆Your misuse of the Service.
• ◆Your violation of any law or third-party rights.
• ◆Any unauthorized sharing of a third party's birth data or personal information.
• ◆Any reliance on or actions taken based on astrological Readings.
• ◆Your violation of the Acceptable Use provisions above.

Suspension and Termination

Termination by You

You may stop using the Service at any time. You may withdraw consent via the consent flow in WhatsApp. To have your Account and data deleted, contact us as described in the Privacy Policy.

Termination by Kundlo

We may suspend or terminate your Account and access to the Service at any time, without prior notice, if:

• ◆You violate these Terms.
• ◆You abuse the Service, the payment system, or the free trial.
• ◆You engage in fraudulent, harmful, or unlawful activity.
• ◆Your continued use poses a risk to the Service, other users, or Kundlo.
• ◆We are required to do so by law or legal process.

Effect of Termination

Upon termination:

• ◆Your Account will be deactivated.
• ◆You will lose access to all Profiles, Readings, PDF Reports, and conversation history.
• ◆No refund will be provided for terminated Accounts (except where required by law).
• ◆Kundlo Points are forfeited upon termination.
• ◆Certain data (financial records, consent audit) will be retained as described in the Privacy Policy.

Modifications to Terms

Updates

We may modify these Terms at any time. When we do:

• ◆We will increase the version number (currently 1.0.0).
• ◆If changes are material, we will require you to re-consent by presenting the updated Terms before you can continue using the Service.
• ◆If changes are immaterial, we will update the Terms with a new effective date without requiring re-consent.
• ◆The previous version will be retained for audit purposes.

Continued Use

After any modification, your continued use of the Service constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

Dispute Resolution

Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.

Jurisdiction

The courts of Kanpur, India shall have exclusive jurisdiction over any disputes arising from these Terms or the Service.

Attempt at Resolution

Before initiating legal proceedings, both parties agree to attempt to resolve the dispute through good-faith negotiations for a period of 30 days from the date a written notice of dispute is given.

General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kundlo regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Waiver

Kundlo's failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or the right to enforce it later.

Assignment

You may not assign or transfer these Terms or your Account to any third party without Kundlo's prior written consent. Kundlo may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.

Force Majeure

Kundlo shall not be liable for any failure or delay in providing the Service due to events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, government action, internet or telecommunications failures, or third-party service outages.

Electronic Acceptance

Your act of tapping "I Agree" constitutes a legally binding electronic signature under the Information Technology Act, 2000 (India), acknowledging your acceptance of these Terms.
